It's legit.

It's still spam.

That is called argument from irrelevency. 'legitimacy' is irrelevant to the question of whether or not a communication is spam.

Doesn't matter, because of what the communication actually is. Spamela would be asking anyone to buy junk, as in it's definition:

"junk on your screen".

It's just asking for charity. No harm done.
