Tenanted property inspections

I was having a chat with my daughter yesterday about tenanted property inspections.

I thought that, these days, the landlord had to have annual inspections for both gas a electrical safety.

However, my daughter is adamant that this only applies to gas safety - there is no gas in her flat and no electrical safety checks have been carried out in the 8 years she's lived there.

Which of us is right?

Presumably, the tenant must be supplied with a copy of any inspection reports?

There's a consultation at the moment over whether to make 5 yearly electrical inspections mandatory (it already is for HMOs).

I thought currently its only if substantial reworking was done. I suppose it depends what you call substantial"! Brian

The tenant is entitled to a copy of the annual gas safety certificate.

There is no requirement for annual inspections of electrics in English non-HMO (AFAIK), but they must be "safe". It's up to the landlord to demonstrate due diligence.

In *Scotland* As of 1st December 2015, under sections 13(4A) and 19B(4) of the Housing (Scotland) Act 2006, for *all* rented property:

As a minimum, an electrical safety inspection must be carried out:

Before a tenancy starts, and During the tenancy, at intervals of no more than five years from the date of the previous inspection.

A copy of the most recent electrical safety inspection reports must be provided to both new and retained tenants.

This is *both* wiring EICR and PAT.

As far as I'm aware (landlord of one flat, managed by a fairly competant agency) annual gas safety inspection is mandatory but electrical check isn't.

Yup, my understanding also.

(Not a landlord myself, but I have a number of lettings agent clients, and also copies of some of the ARLA training manuals)
