Warning re DealExtreme HK

On 23rd October 2008 I purchased an item from the above company via their web site. I had purchased a number of small items before and each transaction had worked smoothly.

This particular item cost me £68 (a web cam) and on delivery I found it did not function as described then within 7 days failed completely, then I found that the item was a fake of a better known product and that the fake item had a reputation for failing in the same manner as mine had failed. The description on their web site matched the spec. of the genuine article, yet the actual spec. didn't come anywhere close to it in resolution or built in function. I spent quite some time chasing the company trying to get them to accept it back for a refund, but eventually managed to get them to agree. It then cost me a further £10 to airmail it back to them, which they agreed to pay.

Four months on, I have still not received the long promised refund. The excuses have ranged from asking me to accept a credit note to spend in their store, to an inability to refund via Paypal due to Paypal's time limit, to latest one - a need for 'the boss' (who happened to be away for two weeks) to approve the refund.

You should immediately start the Paypal disputes procedure. That prevents claims timing out - and it also stops Paypal crediting the seller with your money. The whole Ebay setup is very much slanted on the customer's side.

Yes - I bought a fake Nokia phone off Ebay and got a refund. Via Paypal, so not exactly instant. ;-)

I tried doing that back in October via a Paypal dispute. The dispute ran its course and at the end of it Paypal said they could do nothing, because it was not an Ebay purchase, it was via the sellers own site.

Other then eBay I will not use sites that only accept PayPal. Their "guarantee" has so many caveats it is pretty much worthless. With credit cards if they are processed via PayPal or similar the usual protection does not apply.

Likewise, neither will I (which means I can't ever sell anything through eBay as they've started insisting on it for occasional sellers).

And I think most of the card companies have basically warned that you're on your own if you use them to pay through paypal. It was becoming such a problem for them that many now treat any paypal payments as a cash advance so there's no chance of any refund through them (and in some cases they even charge their cash advance fee for paypal payments).

I've used Paypal over 100 times with no problems. At least it does what it says on the box.

One of my former staff had to take paypal to court to get his money back (that was before they left the UK). Basically, he was just faced with their "couldn't give a shit" attitude, and they definitely picked the wrong guy to treat like that! Of course, you can't do that anymore.

Why on earth not? Does the fact that PayPal is registered in Luxembourg prevent them from being prosecuted in the UK? If so, why?
