Heads up :(

when driving around that bloody new overpass on kenmount road. driving at a normal speed (4:30p) traffic heading east on inside lane. took a

8" peice of angle iron in the front tire, blew the tire and almost rolled the van over into the oncoming lane. back right tire lifted off the pavement - what a rush. made it to general tire - 5" tear in the tire - total write off. plastic liner in wheelwell shredded. guy there said he has had constant business since the construction began on the bridge. any recourse i wonder? not a chance.

This doesn't sound like a home repair question. Maybe you should try a law-oriented newsgroup; in Ontario, we have ont.legal but I'm not sure if there is an nf.legal.

Actually, despite my previous note, it came to me after the previous this is a possible approach.

You can probably get a settlement on the tire from the "road hazard" portion of the tire warranty, particularly helpful if it were still relatively new, of course. Your comprehensive auto coverage should also help, how much depending on the deductible you carry and the amount of damage, of course. After those recourses, depending on local law you might have some recourse against either the DOT or the contractor if it can be shown that the hazard was something the contractor left on the roadway (as opposed to a random piece off some other vehicle or its load.)

If it was definitely construction-related debris there is a resonable chance the DOT holds the contractor responsible as Pops noted--otherwise it's a random road hazard. I looked at the local State DOT site and couldn't find a policy in a quick search but I'm sure there is one.

just in case you are being sarcastic, and i hope your not..you might want to read the reply posts in regards to construction materials left on roads that are not closed during the actual construction phase. and in case you were being sarcastic - you stupid twat - not sure where you hail from but in my city they don't usually randomly toss steel around the roads to make driving any more of a risk than it already was. idiot.

You lucked out then! If it were me, I'd try to identify a company working that site and try contacting them about the damage - you might be pleasantly surprised as they are insured for such things, and obligated to handle them. If it's the wrong company, which is quite possible, they might be able to tell you who it came from. Either way, your local DOT would still be able to give you some further direction. Since you "removed" the debris for them, you may have saved a pretty disastrous accident from happening .

The reason I feel like I know what I'm talking about is I had a chip of concrete come off an overpass and put a good scratch on my windshield. I talked to the foreman at the site and he gave me the place to call, and I had a check within a few days to replace the windshield. One of my nephews is also Town Supervisor and they have the same requirements, and insurance. Letting any debris get off the work site is a serious offense.

There can be plenty of recourse. Contractors are obligated to make a safe workplace, not just for their workers, but for anyone using the roads.

In NC if it is a state road you call up the dept of transportation and they investigate and sometimes they pay up.
