PSE says my transformer can't handle an EV charger, can I install it anyway?

I spent a fortune upgrading my house panel from 100 to 200 amps a few months back specifically for an EV charger. The electrician told PSE about the charger during the permit process. everthing got signed off and the service was upgraded, no problem. Now that I'm actualy ready to install it, my guy called PSE and they're suddenly saying the neighborhood transformer is too weak for the load. I feel like I totally wasted my money on that upgrade if I can't use it. I was talking to a retired inspector I play poker with and he thinks this is nonsense. He said I have no legal requirement to ask the utility for permission once the panel is rated for it, and if thier transformer blows, that's on them. I'm tempted to hire someone else who won't bother asking questions and just pulls the local permit. Is there a rule saying I have to wait for them to upgrade their gear first? Has anyone dealt with this? I don't want to cause a blackout but I need to use my charger. I’m stuck.


Utilities size thier equipment based on diversity, which is a fancy way of saying they assume not everyone is using max power at the same time. When you did that 200A upgrade, PSE had to sign off on the service drop and the meter base. If they didn't upgrade the transformer then, they were gambling that the existing gear could handle the potential load increase. They basically lost that gamble, but now they're trying to make it your problem so they don't have to spend the money on an upgrade yet. Your retired inspector friend is right on the money. Once that 200A panel is installed and the final inspection is signed off, you have a 200A service. As long as your **load calculation** (NEC 220) shows you have the physical room for the charger, you are legally allowed to install it. The utility doesn't typically have veto power over individual appliances or chargers inside a home that has alredy been granted a specific service size. If your panel can handle it and your wiring is up to code, you're good. The issue is your current electrician is asking questions he doesn't actually need to ask. He's asking PSE for a guarentee that their equipment won't fail, and of course, a risk-averse utility is going to say no. But that upgrade could take months or even years if you wait for them. Most guys I know woud just pull the local electrical permit, install the circuit, and have the city or county inspector sign off on it. The local inspector cares about whether your house is safe, not whether the transformer on the pole is having a bad day.

If you're really worried about the neighborhood, you can always schedule the car to charge at 2 AM when the grid load is bottomed out anyway. But honestly, if that transformer fails because of one EV charger, it was already on its last legs and needed replacing. PSE is responsible for the grid up to your service point. If their equipment fails under a load that your permitted panel is rated for, that's a maintenance issue for them to fix on their own dime.

Wait, so is an EV charger actually diffrent from a big AC unit or a hot tub in the eyes of the power company? I'm looking at getting a level 2 charger next year and I didn't realize they could even track what we're using inside the house once the meter is set.

If you just didn't tell them and the transformer actually did blow up, could they come after you for the cost? That's the part that whould scare me. I’m wondering if there’s a way to limit the amps on the charger itself just to be safe while waiting for them to fix their gear.

PSE is just trying to kick the can down the road. If you're stressed about the legal side, look into a load management controller like a DCC-10 or a Wallbox with a power meter. These things monitor your main panel and throttle or shut off the EV charger if the rest of the house starts pulling too much juice.

It basically makes the utility's arguement moot because you’re physically limiting your peak demand. I've seen guys use these to pass inspections in areas with really tight grid constraints. It’s a bit extra for the hardware, but it beats waiting three years for a transformer upgrade.

The utility only knows becuase your electrician volunteered the info. If you aren't trying to get a specific EV rebate or a special off-peak rate, they rarely track what’s going on past the meter. I've seen people run into this when they try to be "too" honest during the service upgrade. If the city inspector signs off on the load calc and the wiring, you're ussually in the clear. Most of the time, those transformer "capacity" warnings are just a desk clerk looking at an old spreadsheet, not an actual engineer's field report.

The weird part is they already signed off on the 200A upgrade. In my neck of the woods, the utility does thier load study the moment that service request hits their desk. If they upgraded your drop and meter base to handle 200A, they’ve already acknowledged the capacity is there.

Just make sure your electrician actually did a proper Article 220 load calculation. If that math shows you have 50A of headroom, PSE’s internal transformer issues aren't your legal problem. They can't pick and choose which 240V appliances you use once the service size is established. Just pull the local permit and skip the utility call.
