First thing I do when fitting a bath is to make sure its going to accept the panel. If this leaves a 2" gap below the tiles you can then offer the customer the choice of border tiles to fill in the gap, or the option of jacking up the bath & bodging the panel.
Whoever fitted it didn't do that, just got her to pay him on the promise of returning to fit the panel (which he must have known wouldn't fit) and not doing so.
