Tree branches hanging over the roof of the new building. Builder/vendor told me that it is not his responsibility to remove the tree branches (some of them are even half dead). He said that it has to be council approval and removed on my cost. Settlement will be in week.

The Builder's right, trees have nothing to do with building defects or whatnot. Sounds like you should read The Contract and see if you can get out of that settlement, with the advent of some Homeowner's Association needing to approve, apparently and literally, anything and everything. I might even call the Building Inspector, as trees aren't supposed to be allowed anywhere that close to any new building.
