issues with a new build house

Hi,

Just moved into a house in the uk. It is two years old and has one previous owner. The developer is still on site and completing the last few houses (so there is still a sales person on site)

We have a couple of problems (nothing too major) but I don't want to get them fixed myself if the builder/developer should still have some responsibility over them.

The problems we have are a faulty boiler, one leaky pipe (all joints soldered and no maintenance valve so a pain to fix) and some dodgy tiling on the roof of the porch.

Does anyone know or can anyone point me in the directions of what rights I have when complaining to the builder of a house that is just over two years old?

I would speak to your conveyancing solicitor to confirm your rights. New houses in the UK come with a 10-year NHBC warranty which should cover all of the things you just mentioned. Give the house builder a call.

just the roof covered after the first 3 years, so get a move on !

if they wont do it, showing up at the same time as a potential customer and whining about the problems should get it done promptly.

The NHBC warranty only covers serious structural problems after two years. Before this they will only cover snagging issues if the original builder has gone bust or won't play ball. This doesn't mean that the builder won't fix problems after two years, it's just that he might choose not to.

I don't know if the Sale Of Goods and Services Act has any bearing; it's supposed to allow for any defects of manufacture or installation to be rectified for a reasonable period, which can be up to 6 years depending on the expected lifespan of the product. Whether a house counts as a product or whether it's just its component parts, I don't know.

Be reasonable in what you want, and the timescales to repair them. Certain 'defects' are normal in a new house (shrinkage cracks in plaster), and some may have happened after the house was handed over but not brought to the builder's attention. Follow up any conversations you have in writing. Speak to the site agent rather than the sales people. If houses are still up for sale on the site, then the builders have an incentive to keep you happy and prevent you kicking up a fuss in front of the show house.
