Time is of the essence with B&Q

So you lost five days wages (or used up five days holiday pay) for items that cost only a few quid?

Here's a free tip for 'next time', order the items through a store, arrange to pick them up at that store, they are open until 8pm every night and also on Saturdays and Sundays, you can ask the staff there to ring you when they arrive, it's quite simple really, even if your nearest store is thirty miles away.

The items are "home delivery" only - I specifically asked if they could be picked up from the store rather than delivered to my home and was told no.

A friend went to a solicitor over something similar. The advice was that you can't claim for a lost day's holiday if it is part of your annual leave, because you have been paid for it by your company -- you haven't lost anything. (Lost time on a day's annual leave is not a recoverable claim.) However, if you took a day's unpaid leave, then you could claim because you have actually lost the money. The unpaid leave could be on a subsequent delivery date rather than the original one.

Which is, of course, utter rubbish.

You have lost one of your allocated days of paid leave.

That has value, and can be claimed for if wasted.

Whether it could be claimed in the circumstances outlined is going to depend on a variety of factors, including what is in the contract.
