Conservatory being built - whose fence is it?

As long as the whole of the structure, including all foundations and gutters, drainpipes etc are on your side of the vertical line delineating the boundary you can build. You have no right of access at all or right to disturb the neighbours land while doing so.

Spoken to neighbour now who isnt that bothered about things and happy for me to extend my wall out and replace the fence.

Luckily, no plants. He doesnt bother with his back garden - which is why I think hes not bothered.

Thanks all. Forgot to add - I'm in Wales where I understand the rules are slightly different.

Forgot about things like gutters also. Of course, if I build right up to the boundary then the gutter would overhang.

Luckily, I have spoken to neighbour and hes a nice guy. Wasn't bothered either way. All he was concerned about was that it was a wall and not just glass (we're just having a top window).

Happy for me to remove the fence and replace with this wall as part of the conservatory.

can I suggest you get that in writing and eventually the letter should be kept with the deeds to your house.

Really? The bargeboard on one of the gables of my house overhangs nextdoor's property, causing no issues when I bought the house. I suspect the deeds say something about reasonable access for maintenance but it's certainly not a problem.

yes really should be a planning law about that it can course incredible grief to future owners
