NHBC again

friend of mine lives in a new build (Wilcon or whatever they call themselves now) 4 bed that has a detached double garage problem is the garage was built into the side of the hill so there is soil banked up against 2 walls this is now causing damp in the garage but Wilcon say it's not covered by the NHBC because it's not attached to the house and they refuse to do anything about it

is that correct ? what can she do about it, if anything ?

she's the 2nd owner btw and the house is about 8y/o

She's unlikely to get anywhere but she should probably contact NHBC direct rather than WilCON. The NHBC Warranty only covers situations where the original builder didn't follow the NHBC Requirements (aka building regs). Don't confuse these with the NHBC Standards, which are much more stringent but not mentioned anywhere in the warranty.

Presumably the work that needs doing is to either (i) excavate a path around the garage and build a retaining wall for the hill, or (ii) insert some sort of waterproof membrane between the hill and the garage wall.

The only situation in which you might get somewhere is if the builder still has a development in the nearby area. A few posters highlighting the problems around the site and an article about poor quality building standards in the local press might well focus the mind of the developer.
