It had to happen :( eBay Q

Its out of the UK, so I guess they can do as they like. Might be worth pointing it out to the company though, in a covering letter. Brian

If you paid via credit card or paypal you should get your money back as incorrect goods have been supplied

I must be lucky, then. Never had a problem with them despite well over

1000 transactions. Mainly buying.

wee update:

I replied to the seller saying I was quite happy for them to replace the item, but that because they had supplied the incorrect item, I would like them to pay the postage, or confirm they would refund it.

Just had a reply saying that because I "ordered the wrong part", I should pay.

So I've replied pointing out that what they supplied was not what I ordered (it has a different part number, for a start), and does not match their confirmation email (which shows the correct part number). I explicitly stated I was rejecting the item as not as described under the SoGA. I doubt the person tasked with replying (from somewhere I suspect in China) either knows, or cares about that. However, it's then embedded in the record, if I need eBay to do something.

There was a UK supplier (well, it may have been), which had the screen at £70, whereas this is £36 ... in any event it's a learning process ;)

I have had a running dispute for the last month with a Chinese run company with a distributing office in London. The original order was delivered with a non-functional item. Over the last 3 weeks I have received two replacements of the item which also failed to work. I said I wanted returns postage for the items returned and after a lot of humming and harring got a refund of postage. I still have an item that does not work and they want me to send it back, they sent me a pre-paid returns label, but I have no access to a printer. I have told them to make arrangements to have the item collected and I will refer the matter to paypal for a charge back.

Only if it £100 or more.

Did you pay by Credit Card? if so, talk to them and raise a dispute.

For now, I'll try to resolve it with the seller - give them the benefit of the doubt, although it's nice to have options.

But was a Credit Card on the end of Paypal?

No, a debit card ... maybe there's mileage in adding a credit card. However (1) I'm not sure I would trust a transaction of over £100 on eBay through PayPal, and (2) I was under the impression that once the credit card company had paid PayPal, they wash their hands of it, and refuse to honour a S75 claim on the grounds that the consumer got what they ordered (credit with PayPal) ?

When I use a CC on paypal, I do not credit Paypal - I pay the merchant using PP as a payment provider. In that respect they are not a lot different to any other payment provider like RBS Worldpay and friends. I'll ask SWMBO - it's her specialist area, she'll know the ins and outs...

Now if I topped up PP funds, then later (even 1 minute later) used those to pay the merchant, I think your analysis would be correct. But I have always made sure not to do that.

Have you ever needed to test this ?

The email I received quoted the correct part number (*N*156 ...)

The delivered part was *B*156.

Subsequent research has shown that *B*156 is a valid part number, but really, that's immaterial. I ordered the correct part (N156) the confirmation confirmed I had ordered N156. I actually got B156.

I've now told the seller I wish to cancel the sale under SoGA ... they've not (yet) responded. If there's any more funny business, I'll just let the eBay 8 day period elapse, and escalate it to their disputes team.

If you paid by Paypal this is not an option

Todays news:

Seller has responded that what they supplied matches the pictures in the listing (which it does) and since that's what I ordered, that's what I got.

I now notice (and didn't before) that they have a line in their listing:

" Unless described as "Original", all items are produced by a 3rd party manufacturer and not the original manufacturer.Original manufacturer Part Numbers(P/N) are provided for cross reference only, the actual part numbers on the product is different."

Which is a great get-out ... they can ship any old crap under the listing which Google found:

"New 15.6" ChiMei Laptop LED Screen Chi Mei N156BGE-L41 Rev C1 WXGA HD UK"

and then when they supply B156TXN03 tell you that you ordered the wrong item.

They've offered to pay 50% of the postage plus refund. I'm too old for this game to push further (I know that would disappoint some posters :) ). However I do have the ultimate - if slightly pinprickish - remedy of bad feedback.

I will take the hit of the postage as a lesson for the future ;). The first lesson is to move eBay sellers down the list of places I would trust in future.

It's not all bad. I ordered a £10 power adapter for my tablet in January. For various reasons it got shoved into my travel bag straightaway, and it was only last month (on a journey) I realised it was the wrong connector. I contacted the seller, and even though it was out of the returns period, they agreed to exchange, which they didn't have to.

There appear to be multiple versions of B156TXN03 which are not compatible with each other, so presumably not all compatible with

"15.6" ChiMei Laptop LED Screen Chi Mei N156BGE-L41 Rev C1 WXGA HD UK"

e.g. B156XTN03.2 (WILL NOT WORK FOR B156XTN03.1

If the P/N they advertised matches yours to revision numbers and is incompatible with what you have they have provided goods differing from their description, regardless of photos.

Assuming you are correct, I would not enter into any negation for a replacement as you have no guarantee they will provide a correct one.

I would reject the goods under the sale of goods act and ask for a full refund. I would only return the goods if they provided upfront a prepaid label or picked it up.

If you don't have the protection of the SOGA I would move ebay to the very bottom of the list of places to shop.

And give the seller one hell of a negative review so the rest of us can avoid the bugger.
